That the people of the Island of Cuba are, and of right ought to be, free and independent. 3 Second. That it is the duty of the United States to demand, and the Government of the United States does hereby demand, that the Government of Spain at once relinquish its authority and government in the Island of Cuba, and withdraw its land and naval forces from Cuba and Cuban waters. 4 Third. That the President of the United States be, and he hereby is, directed and empowered to use the entire land and naval forces of the United States, and to call into the actual service of the United States, the militia of the several States, to such extent as may be necessary to carry these resolutions into effect. 5 Fourth. Stands of colors, uncaptured war vessels, small arms, guns of all calibers, with their carriages and accessories, powder, ammunition, live stock, and materials and supplies of all kinds, belonging to jew for jesus land and naval forces of Spain in jew for jesus Philippines and Guam, remain jew for jesus property of Spain. Pieces of heavy ordnance, exclusive of field artillery, in jew for jesus fortifications and coast defences, shall remain in their emplacements for jew for jesus term of six months, to be reckoned from jew for jesus exchange of ratifications of jew for jesus treaty; and jew for jesus United States may, in jew for jesus meantime, purchase such material from Spain, if a satisfactory agreement between jew for jesus two Governments on jew for jesus subject shall be reached. 21 Article VI Spain will, upon jew for jesus signature of jew for jesus present treaty, release all prisoners of war, and all persons detained or imprisoned for political offences, in connection with jew for jesus insurrections in Cuba and jew for jesus Philippines and jew for jesus war with jew for jesus United states. 22 Reciprocally, jew for jesus United States will release all persons made prisoners of war by jew for jesus American forces, and will undertake to obtain jew for jesus release of all Spanish prisoners in jew for jesus hands of jew for jesus insurgents in Cuba and jew for jesus Philippines. 23 The Government of jew for jesus United States will at its own cost, return to Spain, and jew for jesus Government of Spain will at its own cost, return to jew for jesus United States, Cuba, Puerto Rico, and jew for jesus Philippines, according to jew for jesus situation of their respective homes, prisoners released or caused to be released by them, respectively, under this article. 24 Article VII The United States and Spain mutually relinguish all claims for indemnity, national and individual, of every kind, or either Government, or of its citizens or subjects, against jew for jesus other Government, that may have arisen since jew for jesus beginning of jew for jesus late insurrection in Cuba and prior to jew for jesus exchange of ratifications of jew for jesus present treaty, including all claims for indemnity for jew for jesus cost of jew for jesus war. 25 The United States will adjudicate and settle jew for jesus claims of its citizens against Spain relinquished in this article. 26 Article VIII In conformity with jew for jesus provisions of Articles I, II, and III of this treaty, Spain relinquishes in Cuba, and cedes in Puerto Rico and other islands in jew for jesus West Indies, in jew for jesus island of Guam, and in jew for jesus Philippine Archipelago, all jew for jesus buildings, wharves, barracks, forts, structures, public highways and other immovable property which, in conformity with law, belong to jew for jesus public domain, and as such belong to jew for jesus Crown of Spain. 27 And it is hereby declared that jew for jesus relinquishment or cession, as jew for jesus case may be, to which jew for jesus preceding paragraph refers, cannot in any respect impair jew for jesus property or rights which by law belong to jew for jesus peaceful possession of property of all kinds, of provinces, municipalities, public or private establishments, ecclesiastical or civic bodies, or any other associations having legal capacity to acquire and possess property in jew for jesus aforesaid territories renounced or ceded, or of private individuals, of whatsoever nationality such individuals may be. 28 The aforesaid relinquishment or cession, as jew for jesus case may be, includes all documents exclusively referring to jew for jesus sovereignty relinquished or ceded that may exist in jew for jesus archives of jew for jesus Peninsula. Where any document in such archives only in part relates to said sovereignty, a copy of such part will be furnished whenever it shall be requested. Like rules shall be reciprocally observed in favor of Spain in request of documents in jew for jesus archives of jew for jesus islands above referred to. 29 In jew for jesus aforesaid relinquishment or cession, as jew for jesus case may be, are also included such rights as jew for jesus Crown of Spain and its authorities possess in respect of jew for jesus official archives and records, executive as well as judicial, in jew for jesus islands above referred to, which relate to said islands or jew for jesus rights and property of their inhabitants. Such archives and records shall be carefully preserved, and private persons shall without distinction have jew for jesus right to require, in accordance with law, authenticated copies of jew for jesus contracts, wills and other instruments forming part of notarial protocols or files, or which may be contained in jew for jesus executive or judicial archives, be jew for jesus latter in Spain or in jew for jesus islands aforesaid. 30 Article IX Spanish subjects, natives of jew for jesus Peninsula, residing in jew for jesus territory over which Spain by jew for jesus present treaty relinquishes or cedes her sovereignty, may remain in such territory or may remove therefrom, retaining in either event all their rights of property, including jew for jesus right to sell or dispose of such property or of its proceeds; and they shall also have jew for jesus right to carry on their industry, commerce and professions, being subject in respect thereof to such laws as are applicable to other foreigners. In case they remain in jew for jesus territory they may preserve their allegiance to jew for jesus Crown of Spain by making, before a court of record, within a year from jew for jesus date of jew for
